On November 18th, the Foundation for Research on Law and Business (FIDE) presented in Madrid the Conclusions Document of the Working Group “Approach to Litigation Funding in Spain”.
Over the past months, this group – led by Amanda Cohen Benchetrit, Commercial Judge of the Technical Office of the Spanish Supreme Court (Civil Chamber), and Jesús Rodrigo Lavilla, CEO of PLA Litigation Funding – has carried out a detailed analysis of the current situation of litigation funding in Spain.
The outcome is a document offering a comprehensive view of the sector: its regulatory challenges, operational risks, future opportunities, and the role of funding as a strategic management tool.
The presentation event was opened by Cristina Jiménez Savurido, President of FIDE, and included contributions from Amanda Cohen Benchetrit, Jesús Rodrigo Lavilla and Alipio Conde Herrero, Director at PLA Litigation Funding, who summarised the main conclusions of the work carried out.
The document highlights four key aspects:
- Development and current state of the litigation funding market in Spain, characterised by steady growth and increasing professionalisation.
- The need for a specific regulatory framework, providing transparency, legal certainty and safeguards for all parties involved.
- The relevance of funding in consumer claims, particularly in the context of the upcoming transposition of Directive (EU) 2020/1828.
- The potential of funding in areas such as competition, insolvency and arbitration, where it contributes to efficiency, access to resources and alignment of interests.
The diversity of the professionals involved – judges, lawyers, academics, economists and specialists from the financial sector – has made it possible to address these topics from a broad perspective, combining technical accuracy with practical understanding.
This document represents a significant step towards the consolidation of a responsible, transparent and professionalised industry in Spain, reinforcing the judicial system and promoting effective access to justice.
